Sexually Transmitted Diseases Attorneys / STDs
Sexually transmitted diseases such as herpes and HIV / AIDS can have life-altering and life-threatening consequences. While some people may infect others unknowingly, many others engage in sexual activity with the full knowledge that they are exposing their partners to a dangerous virus.
Innocent people who have been deliberately or negligently infected with a serious sexually transmitted disease may have grounds for legal action in the form of a civil lawsuit. However, this legal practice area is relatively new and not all attorneys understand how to effectively pursue these claims. A law firm with experience in battery / personal injury claims involving STDs can provide advice and skilled representation.
Based in Bloomfield Hills, Michigan, The Stroble Law Firm, P.C. is a full service law firm with a team of knowledgeable personal injury lawyers who are committed to obtaining the best possible financial results for our clients. Our STD attorneys have won several cases on behalf of clients infected with sexually transmitted diseases. We know that an STD can cause serious health complications – not only for the person infected, but unborn children can be harmed as well. We take these claims very seriously and work hard to represent our clients’ best interests.

STDs and the Legal System
A successful STD case will establish that:
- The defendant knew, or should have known, of the condition
- The defendant did not disclose the condition to the sexual partner; and
- The defendant transmitted the condition to the sexual partner.
Most cases involve only serious STDs; diseases which may be easily cured are not typically dealt with in the court system. However, herpes is considered to be a very serious disease and a person who knowingly infects another with the herpes virus may be held liable by a judge. Herpes is a lifelong affliction and can cause very serious complications, including:
- Emotional trauma
- Caesarian-section surgery for any pregnancies; and
- Other birth injuries for any pregnancies.
If a person willingly exposes another to the HIV / AIDS virus, the charges are even more serious. The law considers this to be a criminal charge, and the defendant may be sentenced to jail time by a jury. This does not mean that the victim cannot also bring a lawsuit, however, and anyone infected deliberately with the HIV / AIDS virus may have grounds for a claim.
Treatment for serious sexually transmitted diseases can be expensive. Numerous medications may need to be taken, and there are typically higher future medical costs associated with the complications of an STD. A successful STD claim may result in damages being paid out to the affected individual, including:
- Medical costs
- Pain and suffering; and
- Punitive damages.
