Michigan Supreme Court May Hear Case Related to Fatal Car Accident

The Michigan Supreme Court is examining whether they will hear a case stemming from a fatal Michigan Car Accident caused by a horse that escaped its enclosure. Records show the crash happened in 2010 along a highway 15 miles north of Petoskey in Emmet County, Michigan.

An article published by the Detroit Free Press explained a 42-year-old woman was driving along the highway when she came upon a horse in the road that had escaped from a nearby ranch. The driver was unable to stop in time to avoid a collision with the horse, and the vehicle struck the animal. The impact of the crash killed the horse and the driver of the car.

The mother of the victim later filed a lawsuit against the owners of the horse’s stable, saying their negligence caused the crash. Attorneys for the stable’s owners claimed a family member was in charge of the property at the time of the accident, and therefore, their clients couldn't be held responsible. An Emmet County judge agreed, but his decision was overturned by the state court of appeals.

The Michigan Supreme Court will hear arguments in the matter during the coming months.

The Michigan Personal Injury Attorneys with Michigan Injury Lawyers recognize how difficult proving negligence in the event of an accident can be. The firm suggests discussing your legal options with an attorney if you have been hurt in a motor vehicle collision that wasn't your fault.
